Selling a junk car without a title
Can I sell a junk car in Illinois without the title?
Sometimes, depending on the papers you have. Illinois law requires a scrap buyer to get documentary proof of ownership, such as a title, salvage certificate or junking certificate, plus two IDs. Tell Gold Cash for Junk Cars what you have, like a registration card or old bill of sale, and we confirm on the call whether it works.
The title is the paper that proves you own the car, and in Illinois it matters for a junk sale more than people expect. So the honest answer to “no title?” is: it depends on what else you have. Here is how we handle it.
What Illinois law asks of a scrap buyer
The rule that governs us is 625 ILCS 5/5-401.3. When a scrap buyer takes a vehicle from a private person, two things have to happen:
- Identity. The buyer records the seller’s identification from at least two sources, one of which must be a driver’s license or State ID card.
- Proof of ownership. The seller provides documentary proof of ownership in one of these forms: a Certificate of Title, a Salvage Certificate, a Junking Certificate, a Secretary of State Junking Manifest, a Certificate of Purchase, “or other similar documentary proof of ownership.”
The records are kept for three years, and a licensee who knowingly fails to get proof of ownership faces a Class A misdemeanor. That is why a real buyer asks about papers before sending a truck, and why you should be wary of anyone who says papers don’t matter.
The papers people usually have
When the title is gone, most sellers still have one of these:
- The registration card (the quote form even has an “I have registration only” option).
- An old bill of sale from when they bought the car.
- An insurance card or policy page.
- A loan payoff letter or lien release, if the car was financed.
Whether any of these work depends on the car and its history, so we don’t promise anything in advance. Tell us exactly what you have, and we will say on the call whether we can buy it as is or whether you need to get a duplicate title first. We’d rather tell you no on the phone than waste your afternoon.
The cleanest fix: a duplicate title
If the title is lost, stolen or damaged, the Illinois Secretary of State issues a duplicate. You fill out the Application for Vehicle Transaction(s), form VSD 190, check the duplicate title box, and send it with the $50 fee by mail or take it to an SOS facility. A duplicate won’t be issued within 15 days of the original title or 30 days of a previous duplicate. The step-by-step version is in our article on replacing a lost Illinois title.
If there was a loan on the car, the title goes to the lender while the lien is open. See junking a car with a lien before you apply.
What we won’t do
- We won’t pretend a missing title doesn’t matter. Illinois doesn’t work that way.
- We won’t buy a car the seller can’t show they own, or one whose VIN has been altered or removed. The Illinois Vehicle Code tells recyclers not to acquire those and to call law enforcement.
- We won’t invent an age rule. We have found no Illinois provision letting a scrap buyer take an older car without ownership papers.
What we ask when you call
You give us the year, make, model and what papers you have. We tell you whether the sale can go ahead as is. If it can, you get an offer, we set a pickup, and you are paid at pickup by cash, Zelle or Cash App. If it can’t yet, we tell you what to get first, and the offer can follow once you have it.
Where this comes up
A missing title often goes with a car that sat for years, one inherited from family, or one bought on a handshake. We handle those calls across the area, from Calumet City to Sauk Village and Chicago’s East Side. If the car is also wrecked, see wrecked and totaled cars; if it’s down to scrap, see scrap cars.
Questions people ask
- Is a registration card enough to sell a junk car in Illinois?
- Not always. Illinois requires documentary proof of ownership for a scrap sale, and the law's list starts with the certificate of title. Tell us what you have on the call and we confirm whether it works for your car before anyone drives out.
- How much is a duplicate Illinois title?
- The Illinois Secretary of State lists the duplicate title fee as $50, applied for with form VSD 190 by mail or at an SOS facility.
- The title is in my late parent's name. Can I still sell?
- Possibly, but the paperwork depends on how the estate is being handled. Tell us the situation on the call; we will tell you what we would need to see, and you may need the Secretary of State or the estate's attorney first.
- Is there an age when an Illinois car no longer needs a title to junk?
- We have not found any such rule in the Illinois Vehicle Code sections that govern scrap buyers. Treat any site that promises one with caution.
