Junking a car with an open loan

Can I junk a car that still has a loan on it in Illinois?
Not until the lien is cleared. While a loan is open, the Illinois Secretary of State mails the title to the lender, so you can't sign it over. Pay off the loan, get the lien release, then sell. Gold Cash for Junk Cars can give you an offer first so you know what the car is worth.
A car can die long before the loan does. If you’re still making payments on a car that won’t run, or you paid it off years ago and the lender’s name is still on the title, the paperwork has to be sorted before anyone can buy it. Here’s how it works in Illinois.
Why a lien stops a sale
In Illinois, when a vehicle has a lien, the Secretary of State mails the title to the lienholder. You don’t have it, so you can’t sign it over. And a scrap buyer needs documentary proof of ownership to buy the car at all (625 ILCS 5/5-401.3). Until the lien is cleared, you can’t show clean ownership.
The order to do things
- Get an offer first. Call us with the year, make, model, condition and the fact that there’s a loan. Knowing what the car is worth helps you decide what to do about the balance.
- Get the payoff amount from the lender, including the date it is good through.
- Pay off the loan. The lender then releases the lien. Depending on the lender, you’ll get the title with the lien released, or a lien release letter.
- If the title is lost or still shows the lender, apply for a duplicate with form VSD 190 and include the lien release. The SOS accepts a lien clearance letter, the paid-in-full lien contract, or a court order.
- Sell the car with the clean title, sign it over at pickup, and file the Seller’s Report of Sale.
The duplicate title details are in replacing a lost Illinois title.
The old-loan problem
This one catches people off guard: the loan was paid off long ago, but the lender’s name is still on the title because nobody ever filed the release. Sometimes the lender has merged or closed. The path is the same. Contact the lender (or its successor) for a lien clearance letter. If that’s impossible, the Secretary of State also accepts a court order directing it to issue the title without the lienholder. Either way, the fix is paper, not money.
If you owe more than the car is worth
It can happen when a car is wrecked or breaks down badly early in the loan. Selling the car for junk won’t cover the balance, and the lender still has to release the lien. Some options people use:
- pay the difference out of pocket so the lien can be released,
- talk to the lender about how they handle a vehicle that is no longer worth repairing,
- if insurance is involved after a crash, let the insurance settlement go to the lender first; our wrecked and totaled cars page covers the insurance side.
We can’t give legal or financial advice, but we can give you a firm offer for the car, which is the number you need for any of those conversations. How that number is set is in what a junkyard pays for a car.
What we need at pickup
- The title with the lien released, or the clean duplicate.
- Two forms of ID, one of them a driver’s license or State ID.
- The plates removed (they’re yours in Illinois).
You’re paid at pickup in cash, by Zelle or by Cash App. If you’re in Chicago Heights, Lansing or another town on our list, the tow is free.
Questions people ask
- Who has my title while I'm still paying the loan?
- The Illinois Secretary of State says titles are mailed to the lienholder when a lien is applied, so the lender holds it until the loan is paid.
- The loan was paid off years ago but the title still shows the lender. What now?
- The Secretary of State accepts a lien clearance letter from the lender saying the loan is paid in full, the lien contract showing it was paid, or a court order. Submit one with your duplicate title application.
- Can you pay off my loan and take the car?
- Ask us on the call. We will tell you plainly what we can and can't do for a car with an open loan, but don't count on it before you talk to us.
- What if the car was repossessed?
- Then the lender holds the car, not you. Talk to the lender or a legal aid service about what you still owe.
